Terms and Conditions

1. Bookings, Payment, and Cancellation

  1. The packages presented on our website and booking pages serve as a comprehensive reference to assist clients in identifying their requirements. Please note that all prices are subject to modification following consultation, and services within a package may be amended to accommodate the client’s requests or budgetary constraints.
  2. Reserving a production date guarantees that date solely for your event. Consequently, all booking fees are non-refundable and all sales are final.
  3. Bookings shall be accompanied by a duly executed project agreement and these Terms, which must be signed and paid in full no later than two weeks prior to the scheduled production date, unless otherwise agreed upon in writing.
  4. The rates presented herein do not encompass additional fees, which may include security deposits or cancellation charges. All such fees will be clearly disclosed and mutually agreed upon during the consultation process.
  5. In the event that KVIG is required to reschedule or cancel a confirmed booking due to circumstances beyond our control—such as illness, weather conditions, or other emergencies—we shall endeavor to collaborate with the client in good faith to arrange a rescheduling at the earliest available date without incurring any additional charges.
  6. “Music not applicable” pertains to alterations in music that occur outside the scope of a scheduled revision. Selection of music must take place during the consultation or prior to the designated production day, as it forms an integral component of the artistic and production aesthetic. Revisions shall not encompass modifications to music; any request for a change in music will be classified as an additional edit and will incur an extra fee.
  7. Raw photos and/or raw video footage are not included in standard packages and may be purchased separately at an additional fee.

2. Content Ownership and Reproduction

All content created by KVIG Incorporated, including but not limited to text, images, audio, video, and graphics (the “Content”), is protected by copyright and other intellectual property laws. Any unauthorized reproduction, distribution, or display of the Content without the express written consent of KVIG Incorporated is strictly prohibited.

KVIG Incorporated grants permission to reproduce delivered Content, subject to the following terms and conditions:

  1. The Content must be reproduced in its entirety and may not be altered or edited in any way.
  2. Reproduced Content must include a clear attribution to KVIG Incorporated or the creator, like “@kviginc” or “Created by KVIG Incorporated.” This requirement is for partner or promotional arrangements only and does not apply to à la carte pricing.
  3. Reproduced Content may only be used for non-commercial purposes, including sharing online and on social media outlets. Any commercial use of the Content requires prior written approval from KVIG Incorporated.
  4. The client acknowledges that KVIG Incorporated retains all intellectual property rights in the Content, and that nothing in these Terms shall be construed as a transfer of ownership or a grant of license to those rights.
  5. The client hereby agrees to indemnify, defend, and hold harmless KVIG Incorporated, along with its directors, employees, agents, and affiliates, from and against any and all claims, damages, losses, liabilities, and expenses arising out of or in connection with the client’s reproduction of the Content.
  6. KVIG Incorporated retains the right to rescind reproduction permission at any time in the event of misuse or violation of these Terms. In such instances, KVIG will furnish reasonable advance notice prior to revoking permission for Content that is presently in active use.
  7. Reproduced Content shall not be disseminated to any third party beyond the scope of the agreed-upon quote without prior written consent from KVIG Incorporated. Any unauthorized sharing with third parties may lead to the immediate termination of reproduction rights for all parties involved, without any liability incurred by KVIG Incorporated. This limitation does not apply to parties or individuals who are directly engaged with the event or production.
  8. Clients may elect to share their delivered Content with third parties, contingent upon the payment of a license fee of $179 per page/party by either the client or the third party. Any reproduction of the Content by third parties must adhere to these Terms, and any non-compliance may lead to the immediate revocation of reproduction rights for all parties involved, without any liability to KVIG Incorporated.

The client acknowledges and agrees to these terms and conditions for revisions and reproduction as stated above upon receiving any revision and/or deliverable.

3. Use of Artificial Intelligence

KVIG Incorporated may employ artificial intelligence tools as integral components of our administrative and production processes. This includes, but is not limited to, research, logistics, administration, workflow efficiency, ideation, and the development of conceptual mockups intended to inform and inspire our creative direction. It is important to note that the utilization of such tools does not supersede the creative direction, artistic judgment, or hands-on production expertise that characterize our work. Rather, AI functions as a complement to our processes, and not as a replacement for them.

KVIG Incorporated embraces the evolving significance of artificial intelligence in visual media and public relations. We are eager to offer education, collaboration, and guidance to businesses, including nonprofits and small enterprises, seeking to responsibly enhance their utilization of these tools as integral components of their growth. This commitment extends to KVIG Incorporated itself, as we pledge to continuously learn and adapt in alignment with the businesses and communities we serve.

4. Business Structure

KVIG Incorporated functions as a media collective comprising independent freelancers and does not possess the status of a registered business entity. Clients engage with KVIG Incorporated in its capacity as a collective, and the project contracts will denote the relevant working arrangement.

5. Physical and Digital Copies (Print Release)

This section is included with your media package and serves as your acknowledgment of the terms under which your content has been produced and delivered. By completing payment, you acknowledge and agree to all terms outlined in this section; no additional signature is required.

Physical Copies. Physical copies are delivered without the KVIG Incorporated logo or watermark, as a courtesy to paying clients. The absence of a logo on physical copies does not transfer, waive, or diminish KVIG Incorporated’s intellectual property rights. All imagery, whether delivered physically or digitally, remains the exclusive copyright and intellectual property of KVIG Incorporated. No reprints of any physical or digital media are included beyond what has been delivered in a package; any request for additional prints or copies is subject to a reprint fee, the details of which will be discussed upon contact. Digital Copies. All digital files are delivered with the KVIG Incorporated logo and/or watermark applied. By accepting digital copies, the client acknowledges that: (1) the client has no right to remove, crop, alter, or obscure the logo or watermark from any digital file, including when sharing or publishing content online or across any social media platform; and (2) publishing or distributing digital media with the watermark removed, without prior written authorization from KVIG Incorporated, constitutes a violation of these Terms and applicable copyright law.

Requesting Watermark Removal Rights. Clients who wish to obtain rights to use digital media without the KVIG Incorporated watermark or logo may submit a request by contacting us at contact@kviginc.com or through kviginc.com. All requests are subject to review and approval at the sole discretion of KVIG Incorporated and may be subject to additional terms and fees.

By paying for a media package, the client absolves KVIG Incorporated and its representatives from any liability connected to the utilization of these materials, and relinquishes any claims or demands arising from the usage or distribution of the delivered content in accordance with these Terms. This section is effective upon payment of a media package; clients should retain a copy for their records.

6. Revisions

KVIG Incorporated provides revision services for its clients to help ensure the final product meets the client’s expectations. The following terms apply to all revision requests:

  1. Revision requests must be submitted in writing and clearly state the changes requested.
  2. KVIG Incorporated will provide one free round of revisions, subject to the agreed quote.
  3. Any additional revisions beyond the agreed quote will be subject to a $79 fee per revision.
  4. Revisions that interfere with the creative process and/or vision may be declined at the discretion of KVIG Incorporated, unless the client is willing to pay the $79 fee per revision.
  5. Revision requests must be submitted within 5 business days of receipt of the deliverables.
  6. KVIG Incorporated reserves the right to decline revision requests that are outside the scope of the agreed-upon project.
  7. Any delays in revision requests by the client may result in a delay in the final delivery of the project.
  8. The client agrees to review and provide feedback on revisions in a timely manner to help ensure timely completion of the project.
  9. The client acknowledges that any changes made to the original project scope or objectives may result in additional fees and an extension of the project timeline.

The client acknowledges and agrees to these terms and conditions for revisions as stated above upon receiving any revision and/or deliverable.

7. Image and Likeness Release

By attending, participating in, or being present within or around the area of a KVIG Incorporated production — whether as hired talent, an event attendee, a client representative, crew, or a member of the public in the surrounding area — an individual’s presence constitutes full consent for KVIG Incorporated to capture, use, edit, and reproduce their image, likeness, and voice as part of the delivered Content and KVIG Incorporated’s portfolio, marketing, and promotional materials, unless a separate written agreement states otherwise.

The only means of opting out of this consent is to leave the production area. KVIG Incorporated is under no obligation to pause, adjust, or reshoot a production to accommodate an individual’s presence, and cannot guarantee exclusion from any footage or images captured while that individual remained within or around the area.

No compensation may be requested by any individual for appearing in Content on the basis of this release, and no claim, demand, or legal action may be pursued against KVIG Incorporated arising from the use of an individual’s image, likeness, or voice under this Section, except where a separate written agreement (such as a talent or model contract) states otherwise.

Minors. Productions frequently take place at events, venues, or public and semi-public locations where minors may be present, and it is not always possible to identify, reach, or obtain guardian consent for every minor who may appear in captured footage before or during production. KVIG Incorporated will proceed with filming, editing, and delivering the production to the client regardless of whether guardian consent has been obtained for any minor appearing in the Content.

It is the client’s sole responsibility — not KVIG Incorporated’s — to identify any minors appearing in the delivered Content and to obtain any necessary parental or guardian consent before publishing, distributing, or otherwise using footage or images featuring a minor, whether that consent is sought before the production date or after delivery. KVIG Incorporated bears no responsibility for seeking, obtaining, or verifying any such consent.

The only guardian or parental signatures KVIG Incorporated will seek are those tied directly to individuals engaged for the core production itself (e.g., a minor hired as talent for the shoot). This obligation does not extend to any other minor present at or around a production, including event attendees, guests, or bystanders.

Clients are responsible for obtaining any necessary permissions or releases from their own staff, guests, or invitees who may appear on camera during a production, except where KVIG Incorporated has agreed in writing to handle releases directly.

8. Governing Law and Changes to These Terms

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada.

KVIG Incorporated may update or change these Terms, this disclaimer, or any related policy at any time. The most current version will always be available on our website.
